2. What these terms cover

These terms and conditions apply to consumer purchases and certain bookings through themagicgarden.dk, unless something else is clearly stated.

They cover:

• physical and digital products sold through the webshop, for example books, art posters and digital products
• tickets for Full Moon Concerts and other events on a set date that are bought through the website, including through the events calendar
• certain retreats and private sessions that are arranged directly with us, where these general terms are supplemented by separate written terms

If separate written terms are sent for a retreat, a private booking, an event or another specific service, they apply together with these terms and conditions. If the two disagree, the separate terms take priority for that specific booking.

3. Webshop products and availability

We take care to present our webshop products as clearly and accurately as possible. Small differences may still occur, for example in colour, size or display, depending on your screen or device. All products are offered subject to availability, and we reserve the right to update, change or discontinue products without notice. If a product becomes unavailable after you have placed your order, we will let you know as soon as possible and refund any amount you have paid for that product.

4. Full Moon Concerts and other event tickets

This section applies to tickets for Full Moon Concerts and other events on a set date that are sold through themagicgarden.dk, including tickets bought through the events calendar on the website.

Each ticket is valid for the specific event, date, time and, where relevant, type of admission shown when you buy it. Event information shown on the event page, during the purchase, in the ticket e-mail or in other relevant messages about the event is part of the agreement.

Tickets for Full Moon Concerts and other events on a set date can be passed on to another person, unless something else is clearly stated for that event. If you pass your ticket on, you are responsible for making sure the new ticket holder receives the relevant information about the event.

Because these tickets are for leisure activities on a specific date or in a specific period, the usual 14-day right of withdrawal does not apply to these purchases.

Any ticket fees, booking fees or similar fees shown during the purchase are part of the total price.

If we cancel an event or change it significantly, we will contact the ticket buyer using the details given at the time of purchase and explain the options that apply to that event and under the law.

5. Retreats and private bookings

Certain retreats and private sessions at The Magic Garden are arranged directly with us and are not bought through the website. These may be, for example, retreats, private ceremonies, readings, consultations or other individually arranged programmes.

Detailed terms on booking, payment, cancellation, rebooking, practical matters and any special conditions are sent to you directly in writing before the booking and payment are confirmed.

If a service is to begin before any statutory withdrawal period has ended, we may ask you to confirm this as part of the booking.

6. Prices and payment

All prices on the website are in Danish kroner (DKK), or in the currency shown at checkout, and include VAT where applicable, unless otherwise stated.

Any delivery costs, ticket fees, booking fees or other relevant costs will be shown before you complete your purchase or ticket purchase.

You can pay with the payment methods offered at the relevant checkout. For retreats and private bookings arranged directly with us, the price, any deposit, the payment plan and the due dates will be set out in the written correspondence about your booking or in the separate booking terms.

If an obvious pricing error occurs, we reserve the right to correct it and, if necessary, cancel the order or booking concerned before it is completed.

7. Ordering and making the agreement

When you place an order or buy a ticket on the website, you are making an offer to buy the chosen product, ticket or service.

For webshop products and event tickets bought online, a binding agreement is normally made when we accept your order and send an order confirmation, confirmation e-mail or ticket e-mail, unless the order is declined for legal, technical, stock, payment or pricing reasons.

For retreats and private bookings arranged directly with us, a binding agreement is made when we confirm the booking in writing, or when payment or a deposit is received after the relevant terms have been sent to you, depending on what is stated in the correspondence about that booking.

Please make sure that the information you give when buying or booking is correct and complete.

8. Delivery of physical products

Physical products such as books and art posters are delivered to the delivery address you give at checkout. Delivery times, delivery methods and delivery costs are shown on the website, at checkout or in your order confirmation. The risk for the item passes to you when you, or a person you have named, physically receive it. We recommend that you check the parcel and the product when it arrives and contact us as soon as possible if anything seems wrong or damaged.

9. Delivery of digital products

Digital products are delivered electronically, for example by download link, by e-mail, as access on screen or in another digital way stated on the website. Unless otherwise stated, digital products are normally made available shortly after payment is completed. You are responsible for making sure your device, software, internet connection and e-mail access are suitable for receiving and using the digital product.

10. Right of withdrawal for webshop purchases

If you are a consumer, you normally have a 14-day right of withdrawal for qualifying online purchases in the webshop, without having to give any reason.

For physical goods, the withdrawal period ends 14 days after the day on which you, or a third party you have named, receive the goods. If you want to use your right of withdrawal, you must tell us clearly before the period ends. You can use the standard withdrawal form at the bottom of this page, but you do not have to.

After you have told us that you want to withdraw from the purchase, you must send the goods back without undue delay and no later than 14 days after the day you told us.

For digital products that are not delivered on a physical medium, the withdrawal period normally runs for 14 days from the day the agreement is made. If you expressly agree that delivery may begin before the withdrawal period ends, and at the same time acknowledge that you thereby lose your right of withdrawal, the right of withdrawal ends once delivery or performance has begun.

The right of withdrawal does not apply to tickets for Full Moon Concerts or other leisure events on a set date.

Nor does it apply in other cases where the law makes an exception, for example for clearly personalised products. For retreats and private bookings, any statutory withdrawal rights depend on the nature of the service and the specific booking, and the relevant information is given during the direct booking process.

11. Returns and refunds

This section applies to webshop purchases where these terms and conditions or the law that applies give a right to return or a refund.

If you validly withdraw from a purchase of physical goods, we will refund all amounts we have received from you for those goods, including the original standard delivery costs, without undue delay and no later than 14 days after we have received your notice of withdrawal.

We may hold back the refund until we have received the goods back, or until you have sent proof that you have returned them, whichever comes first.

Unless otherwise agreed or required by law, you pay the direct cost of returning the goods.

Refunds are normally made with the same means of payment you used for the original payment, unless we expressly agree otherwise.

You are only liable for any reduction in the value of the goods if it results from handling them more than is needed to establish their nature, characteristics and functioning. Refunds for event tickets, retreats or other bookings follow the terms that apply to that specific service.

12. Complaints and defects

As a consumer, you have a 24-month right to complain under købeloven, the Danish Sale of Goods Act, when you buy goods from a business. This means that you can complain about faults or defects in physical goods for up to 24 months after delivery, if the conditions in the law are met.

If you find a fault or defect, please contact us as soon as possible and describe the problem. If the complaint is justified, you may, depending on the circumstances, be entitled to a repair, a replacement, a price reduction or a refund, as the law allows.

For digital products, your rights under consumer law that cannot be waived are not affected. If a digital product is faulty, unavailable or not delivered as agreed, please contact us so that we can look into it and help find a solution.

If your complaint is about a ticket, the delivery of a ticket or a specific matter during an event, please contact us as soon as possible. Where relevant, please also point the matter out during the event, if it can reasonably be solved there and then.

13. Copyright and use

All content sold or made available through the website, including digital products, text, audio, video, images, artworks, graphics and design, is protected by copyright and other intellectual property rights.

Unless something else is clearly agreed in writing, your purchase gives you a personal, non-exclusive and non-transferable right to use the product for private use. You may not copy, resell, distribute, share, publish, sublicense, use commercially or in any other way make the product available to others without our prior written permission.

14. Personal data

We process personal data in line with the data protection law that applies. You can read more in our privacy policy about how we collect, use and protect your personal data.

15. Limitation of liability

Nothing in these terms and conditions limits the consumer rights or the liability that cannot lawfully be waived or limited under the law that applies. As far as the law allows, we are not liable for indirect loss or consequential damage. Nor are we liable for delays or failure to perform caused by circumstances beyond our reasonable control.

16. Governing law and complaints

These terms and conditions are governed by Danish law, without affecting any mandatory consumer rights you may have under the law of the country where you live.

If you have a complaint, please contact us first at info@themagicgarden.dk, so that we can try to find a solution directly and properly.

If we cannot find a solution together, you may in some cases take your complaint further through Nævnenes Hus, the Danish public body for complaint boards. There, its mediation team for consumer complaints (Mæglingsteamet for Forbrugerklager) and, where relevant, Forbrugerklagenævnet, the Danish Consumer Complaints Board, deal with relevant consumer cases, depending on the nature of the case and the conditions that apply.

17. Standard withdrawal form

This standard withdrawal form only applies where there is a statutory right of withdrawal, for example for qualifying webshop purchases. It does not apply to tickets for Full Moon Concerts or other events on a set date, where the right of withdrawal does not apply.
