2. Scope of these terms

These Terms and Conditions apply to consumer purchases and certain bookings made through themagicgarden.dk, unless otherwise clearly stated.

They cover:

  • physical and digital products sold through the webshop, such as books, art posters, and digital products

  • full moon concert tickets and other date-specific event tickets sold through the website, including tickets purchased through the event calendar on our website

  • certain retreats and private services arranged directly with us, where these general terms are supplemented by separate written booking terms

If separate written terms are provided for a retreat, private booking, event, or other specific offering, those terms apply alongside these Terms and Conditions and will prevail where there is any inconsistency.

3. Webshop products and availability

We do our best to present our webshop products as clearly and accurately as possible. Small differences may occur, for example in colours, dimensions, or presentation, depending on your screen or device. All products are offered subject to availability, and we reserve the right to update, change, or discontinue products without prior notice. If a product becomes unavailable after you place an order, we will let you know as soon as reasonably possible and refund any amount paid for that unavailable product.

4. Full moon concert tickets and other event tickets

This section applies to full moon concert tickets and other date-specific event tickets sold through themagicgarden.dk, including tickets purchased through the event calendar on our website.

Each ticket is valid for the specific event, date, time, and, where relevant, seat or access type stated at the time of purchase. Any event-specific information shown on the event page, during checkout, in the ticket confirmation, or in related event communication also forms part of the agreement.

Tickets for full moon concerts and other date-specific events may be given to another person, unless otherwise clearly stated for the specific event. If you pass your ticket on to someone else, you are responsible for ensuring that the new ticket holder receives all relevant event information.

Because these tickets relate to leisure services connected to a specific date or period, the usual 14-day right of withdrawal does not apply to these purchases.

Any ticket fees, booking fees, or similar charges shown during the purchase process form part of the total purchase price.

If an event is cancelled or materially changed by us, we will contact ticket holders using the information provided during purchase and let you know what options are available under the relevant event terms and applicable law.

5. Retreats and private bookings

Certain retreats and private services offered by The Magic Garden are arranged directly with us rather than purchased through the website. This may include, for example, retreats, private ceremonies, readings, consultations, or other individually arranged offerings.

Detailed terms relating to booking, payment, cancellation, rescheduling, practical requirements, and any service-specific conditions are shared directly with you in writing before confirmation and payment.

If a service is to begin before any statutory withdrawal period has expired, we may ask you to confirm this as part of the booking process.

6. Prices and payment

All prices shown on the website are in the currency indicated at checkout and include VAT where applicable, unless otherwise stated.

Any delivery charges, ticket fees, booking fees, or other applicable charges will be shown before you complete your order or ticket purchase.

Payment may be made using the payment methods made available in the relevant checkout or ticket purchase process. For retreats and private bookings arranged directly with us, prices, deposit requirements, payment schedules, and due dates will be stated in the individual booking correspondence or separate booking terms.

If an obvious pricing error appears, we reserve the right to correct it and, where necessary, cancel the affected order or booking before fulfilment.

7. Ordering and contract formation

When you place an order or purchase a ticket through the website, you submit an offer to purchase the selected product, ticket, or offering.

For webshop products and event tickets purchased online, a binding contract is normally formed when we accept your order and send an order confirmation, confirmation email, or ticket confirmation, unless the order is rejected for legal, technical, stock, payment, or pricing reasons.

For retreats and private bookings arranged directly with us, a binding agreement is formed when we confirm the booking in writing, or when payment or a deposit is received after the relevant terms have been provided, depending on what is stated in the booking correspondence.

Please make sure that the information you provide during checkout or booking is accurate and complete.

8. Delivery of physical products

Physical products such as books and art posters are delivered to the delivery address you provide at checkout. Delivery times, delivery methods, and delivery costs are shown on the website, at checkout, or in your order confirmation. Risk in the goods passes to you when you, or a person identified by you, takes physical possession of the goods. Please inspect the package and the product when it arrives and contact us as soon as possible if anything appears damaged or incorrect.

9. Delivery of digital products

Digital products are delivered electronically, for example by download link, email, on-screen access, or through another digital delivery method stated on the website. Unless otherwise stated, digital products are usually made available shortly after successful payment. You are responsible for ensuring that your device, software, internet connection, and email access are suitable for receiving and using the digital product.

10. Right of withdrawal for webshop purchases

If you are a consumer, you generally have the right to withdraw from a qualifying online webshop purchase within 14 days without giving any reason.

For physical goods, the withdrawal period expires 14 days after the day on which you, or a third party indicated by you, receives the goods. To use your right of withdrawal, you must notify us with a clear statement before the withdrawal period expires. You may use the model withdrawal form at the end of these Terms and Conditions, but it is not required.

After notifying us, you must return the goods without undue delay and no later than 14 days from the date on which you informed us that you wish to withdraw from the contract.

For digital products not supplied on a tangible medium, the withdrawal period generally runs for 14 days from the date of contract conclusion. However, if you expressly consent to immediate delivery before the withdrawal period expires and acknowledge that you thereby lose your right of withdrawal, your right of withdrawal ends once delivery or performance has begun.

The right of withdrawal does not apply to full moon concert tickets or other event tickets for date-specific leisure services.

The right of withdrawal also does not apply in certain other legally exempt cases, for example clearly personalised products or other exemptions provided by applicable consumer law. For retreats and private bookings, any statutory withdrawal rights depend on the nature of the service and the specific booking arrangement, and the relevant information will be shared directly during the booking process.

11. Returns and refunds

This section applies to qualifying webshop purchases where a return or refund right exists under these Terms and Conditions or applicable law.

If you validly withdraw from a purchase of physical goods, we will reimburse all payments received from you for the withdrawn goods, including the original standard delivery costs, without undue delay and no later than 14 days after we receive your notice of withdrawal.

We may withhold reimbursement until we have received the returned goods or until you have provided documentation that the goods have been returned, whichever occurs first.

Unless otherwise agreed or required by law, you are responsible for the direct cost of returning the goods.

Refunds will be made using the same payment method that you used for the original transaction, unless we have expressly agreed otherwise with you.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. Refunds relating to event tickets, retreats, or other bookings are governed by the specific terms shared for the relevant offering.

12. Complaints and faulty goods

Under Danish consumer law, consumers generally have a two-year legal warranty for faulty goods purchased from a trader. This means that you may complain about defects or lack of conformity in physical goods within two years from delivery, provided that the legal conditions are met.

If you discover a fault, please contact us as soon as reasonably possible and describe the problem. If the complaint is justified, you may be entitled to repair, replacement, a price reduction, or a refund, depending on the circumstances and applicable law.

For digital products, your mandatory rights under applicable consumer law remain unaffected. If a digital product is defective, inaccessible, or not supplied as agreed, please contact us so we can assess and resolve the issue.

If your complaint concerns an event ticket, ticket delivery, or a factual issue connected with an event, please contact us as soon as possible. Where relevant, issues should also be raised during the event if they can reasonably be addressed there and then.

13. Intellectual property and permitted use

All content sold or made available through the website, including digital products, text, audio, video, images, artwork, graphics, and design, remains protected by copyright and other intellectual property rights.

Unless otherwise clearly agreed in writing, your purchase gives you a personal, non-exclusive, non-transferable right to use the product for your own private use only. You may not reproduce, resell, distribute, share, publish, sublicense, commercially exploit, or make the product available to third parties without prior written permission.

14. Personal data

We process personal data in accordance with applicable data protection law. Please see our Privacy Policy for information about how we collect, use, and protect your personal data.

15. Limitation of liability

Nothing in these Terms and Conditions limits any consumer rights or liability that cannot be excluded or limited under applicable law. To the extent permitted by law, we are not liable for indirect or consequential losses. We are not responsible for delays or failures caused by circumstances beyond our reasonable control.

16. Governing law and complaints handling

These Terms and Conditions are governed by Danish law, without prejudice to any mandatory consumer protection rights that may apply under the law of your country of residence.

If you have a complaint, please contact us first at info@themagicgarden.dk so we can try to resolve the matter directly and with care.

If we are unable to reach a solution, you may be able to submit a complaint to the relevant Danish consumer complaints body, including Nævnenes Hus, subject to the applicable conditions, thresholds, and areas of competence.

17. Model withdrawal form

This model withdrawal form applies only where a statutory right of withdrawal exists, for example for qualifying webshop purchases. It does not apply to full moon concert tickets or other date-specific event tickets where the right of withdrawal does not apply.

If you wish to withdraw from a qualifying contract, you may complete and send this form, but this is not obligatory:
